Can I keep employee 1-9s with other files like personnel or medical?
1-9’s should not be kept in an employee’s personnel file or medical/confidential folder. They should be kept in a notebook or separate file and placed in a locked cabinet which is separate from both the personnel and medical files.
How do I maintain compliance for my employee files?
Employers should maintain atleast two files for each employee, a personnel file and a medical/confidential file. Payroll files are generally kept separately with the accounting/payroll function. Compliance regulations require that specific paperwork be kept in each respective file.
Where must I post state and federal labor posters?
State and Federal labor posters must be posted in a central location where all employees may review the information. They may be also be posted on line or on the organization’s Intranet, but they must be readily visible to staff at all locations.
Do I Still have to provide COBRA benefits even if I have less than 20 employee?
Several states have mini COBRA requirements even if your employee count is less than 20 employees. Be sure to check your state’s requirements when an employee terminates from your company.
Is there any reason I do not have to offer COBRA to a departing employee?
Gross misconduct may disqualify an employee from receiving COBRA. Be sure to understand what the definition of gross misconduct is so you are not faced with severe penalties for not offering COBRA.

Employers often review their employee handbook with their staff at least once a year and require new acknowledgement forms to be completed. This insures that staff and management are both current on the policies and procedures of the company.
